Article 1: Fields of application and modification of the general conditions of sale

These general conditions of sale apply to all orders placed on the website www.mapalga.fr

Opening an account with our company or placing an order with us, whether by telephone or in writing, automatically entails, on the part of the customer, acceptance and unreserved adherence to these conditions.

MAPALGA reserves the right to adapt or modify these general conditions of sale at any time. In the event of modification, the general conditions of sale in force on the day the order is placed will be applied to each order.

 Article 2: Price

Prices are expressed in euros including tax and exclude transport costs. The user will have to pay these transport costs, unless he benefits from a special offer on the portal exempting him from this. MAPALGA reserves the right to modify its prices at any time, in particular in the event of an increase in charges, the VAT rate or in the event of a manifest error, but undertakes to apply the prices in force which will have been indicated to you at the time of your order, subject to availability on that date.

Article 3: Payment terms and security

Terms

Payment can be made by credit card, bank check, gift vouchers or via PAYPAL. 

In the event of payment on the site, the information that the user will enter (your card number and expiry date) will be encrypted on their computer and will not circulate "in the clear" on the Internet. Their bank details circulate between banks only. They will never be communicated to MAPALGA.

This is why they will be requested again for each new transaction on the site.

Securing

In order to speed up order processing, we recommend online payment, through the secure payment solution; the order will thus be recorded and validated upon acceptance of payment by our banking service.

Article 4: Reservation of title clause, default of payment

Retention of title clause

The products remain the property of the company MAPALGA until full payment of the order. However, upon delivery to the carrier, the risks of the delivered goods are transferred to the customer.

Default in payment

MAPALGA reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is being administered.

Article 5: Anti-fraud controls

As part of our procedures, we may ask you for all the documents necessary to release your order: proof of address and debit in your name, etc. These requests are made by email.

Article 6: Product availability

Our product offers are valid while stocks last and we do our best to serve the customer as quickly as possible. In the event of unavailability, we undertake within 30 days of placing the order either to deliver the ordered product to you or to offer you a similar product at a similar price or to reimburse you for it. Upon receipt of your order, we check the availability of the product(s) ordered.

Article 7: Delivery terms and deadlines

MAPALGA offers different means of delivering packages to the customer, directly to your address, at a relay point...

On request, MAPALGA can send you an order tracking number, but cannot be held responsible in the event of non-delivery by the carrier.

Packages are generally shipped within 48 hours after receipt of your payment. If we can do it faster, of course we do. Shipping costs include packaging, handling and freight charges.

Shipping costs are not included in the prices displayed on the site and are indicated in the order summary before payment. The related shipping costs will be the responsibility of the customer.

Customs charges may apply which will be the responsibility of the customer. MAPALGA does not cover customs duties or additional taxes in the destination region or country.

The products offered by our partners will be shipped via their usual carriers.

Mapalga.fr cannot be held responsible for the consequences due to a delay in delivery on the part of the carrier. Mapalga.fr may exempt itself from all liability by providing proof that the non-performance or poor performance of the contract is attributable either to the consumer, or to the unforeseeable and insurmountable act of a third party to the contract.

Some of the products presented on this site could be presented by external partners and can be shipped by them directly.  MAPALGA disclaims all liability regarding our partners' products (manufacturing defects, delivery delays, etc.).

In the event of a problem with one of the partner products, MAPALGA undertakes to send its contact details to the customer and to contact them directly to find solutions satisfying both parties.

Deadlines

MAPALGA undertakes to do everything possible to deliver the products ordered as quickly as possible; this period may vary from 3 to 12 days. However, linked to other service providers for delivery, MAPALGA cannot guarantee this time, which is simply given as an indication.

MAPALGA is in fact linked to its service providers for delivery, but in accordance with the consumer law of March 18, 2014, known as the Hamon Law, MAPALGA undertakes to deliver the order within 30 days maximum.

If the product ordered belongs to and is deliverable by a partner, MAPALGA will contact it for rapid shipping.

We strongly recommend that the customer check the packages in the presence of the delivery person.

In the event of material damage, the customer must indicate it on the delivery receipt. In the event that the goods are not delivered, the customer is requested to inform our services within 2 weeks after placing their order. Any delays do not entitle the buyer to cancel the sale, refuse the goods or claim damages. The goods always travel at the risk of the recipient. Always check your package upon arrival.The customer has 48 hours to make any reservations with the carrier in the event of something missing or damaged.

Article 8. Force majeure

Expressly, are considered as cases of force majeure, in addition to those usually retained by the jurisprudence of French courts: total or partial strikes (internal or external to the company), bad weather, epidemics, blockage of means of transport or supply for any reason whatsoever, earthquakes, fires, storms, floods, water damage, restrictions governmental or legal changes, legal or regulatory changes to forms of marketing, total or partial blocking of means of telecommunications and communication, including networks and services and all other cases beyond the express will of the parties and preventing the normal execution of these presents.

Article 9: Responsibilities

MAPALGA cannot be held responsible for non-performance of the contract due to a case of force majeure, fortuitous event, disruption or total or partial strike, particularly of transport and/or communications partners, flood, fire.

The choice and purchase of a product are the sole responsibility of the customer. The total or partial impossibility of using the products, in particular due to incompatibility of the equipment, cannot give rise to any compensation, reimbursement or questioning of the liability of the Mapalga.fr site.

In the event of non-delivery of an order or part of an order, the customer has a maximum of one month (from the date of placing the order) to alert MAPALGA. Beyond this period our services can no longer accept complaints.

In the event of purchasing a product from one of our partners, the customer must contact them for any questions concerning their purchase (delivery, manufacturing defect, etc.), responsibility and compliance with the legislation in force for the product belong to our partner.

Article 10: Right of withdrawal and return terms

Right of withdrawal

In accordance with article Art. L. 121-21-8. From the Consumer Code of March 18, 2014, known as the Hamon law, the right of withdrawal cannot be exercised for an order for perishable food(s), goods likely to deteriorate, expire quickly or be unsealed by the recipient.

If the purchase concerns devices, accessories or non-perishable goods, in accordance with the law relating to consumption of March 18, 2014, known as the Hamon Law, the consumer has a period of fourteen days to exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception, where applicable, of return costs, subject to returning the product unopened, unused, complete, in perfect condition, showing no trace of shock or malfunction, in their original packaging ( unopened plastic film and without any trace of assembly or use ). Otherwise, no refund will be made.

The period mentioned above starts from the actual receipt* of the order placed on the Mapalga.fr website. The right of withdrawal must be exercised by sending an email confirming the order accompanied by a letter expressing the Customer's unequivocal intention to exercise his right of withdrawal, by registered letter with acknowledgment of receipt addressed to the following address: MAPALGA Sarl, 64 industrial zone Fernand Finel 50430 LESSAY. Any return made in accordance with the conditions of this article will give rise to a refund of the entire sums paid no later than fourteen days from receipt of the right of withdrawal.

* The right of withdrawal is linked to actual receipt, that is to say when the package has been delivered to the address provided by the customer according to proof provided by the carrier, or when the package has been taken into account by the customer at the relay point (or at the distribution point).

If the customer does not collect their package from the relay point within 8 days and it is returned to MAPALGA, then the right of withdrawal cannot be exercised. MAPALGA can then send the customer his package at his expense via the carrier of his choice as long as he sends a transport voucher paid for the expected weight.

Terms of withdrawal : The product must be returned in its original and complete condition (packaging, accessories, instructions, etc.) and must be accompanied by the purchase invoice. Items used, incomplete, damaged,damaged or in such a dirty state that they are unsaleable will be returned to the customer or refunded at a discount. This discount is at least 20% of the price.

The customer can reship their package at their own expense via the carrier of their choice to the MAPALGA address indicated at the footer of the delivery note.

The customer is responsible for the proper delivery of the products and in particular for the ad valorem insurance of these products.

No cash on delivery will be accepted.

Article 11: Coverage of return costs linked to a delivery error and reimbursement terms

In the event of a delivery error on the part of MAPALGA, the return and reshipment costs will be borne by it regardless of the mode of transport chosen.

If the return is at the customer's request then the return costs are not taken into account, likewise the refund will be made after deduction of any outward delivery costs.

Reimbursement terms

MAPALGA undertakes to reimburse the customer within a maximum of fifteen (15) days from the date on which they exercised their right of withdrawal. If the customer returns their order in its entirety without any damage or trace of use, MAPALGA will then reimburse the total amount after deduction of delivery costs.

Disputes

Complaints or disputes will always be received with attentive kindness, good faith always being presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will contact the company as a priority to obtain an amicable solution. Failing this, the Coutances Commercial Court has sole jurisdiction. Any dispute will be subject to French law

After-sales service conditions for SAECO Professional coffee machines

SAECO professional range machines purchased by the customer on the Mapalga.fr website benefit from a two-year warranty which applies as follows: when intervention is necessary, the user contacts the after-sales service, which is open Monday to Friday from 8 a.m. to 12:40 p.m. and from 1:30 p.m. to 5 p.m. If the advice and tests carried out by telephone do not resolve the problem, the after-sales service then decides to send a loaner machine to the customer within 24 hours, and take back the faulty device so that it can be checked and repaired in the brand's workshops. When the device is repaired, it is delivered to the customer and the loaner device is then taken back.

The 2-year warranty (parts and labor) does not cover consumables (descaler, filters, etc.) damage due to limescale, operating faults linked to the use of accessories not recognized by SAECO, the consequences of any transformation, dismantling of the device, as well as any damage not objectively attributable to the device itself (fall of the device, mechanical shocks, electric shocks, flooding, exposure to humidity, frost, etc.), likewise, misuse, handling errors, lack of maintenance and their consequences are not covered by the warranty.

Warranty conditions for spare parts

Spare parts are covered by a 3-month warranty depending on the date of sale. Note, spare parts damaged, dismantled or in contact with external elements (traces of hard water in particular or lack of maintenance) cannot benefit from the guarantee.

Spare parts supplied by us during repairs of a device in our workshop benefit from a 6-month warranty.

Article 13: IT Provisions and Freedoms

The customer has the right to access, modify, rectify and delete data concerning him (art 34 of the “Informatique et Libertés” law of January 6, 1978).

Article 14:Applicable Law and Jurisdiction

All relationships arising from the connection and/or use of this site are subject to French law.

The competent court in the event of a dispute will be the Coutances court.
